Agreement and scope
These Terms of Service (“Terms”) are an agreement between you and BakeDrop (“BakeDrop,” “we,” “us,” or “our”). They govern your use of pdxbakedrop.com and your purchase of baked goods or baking-related services from us.
By using the website, you agree to the website portions of these Terms. Sending an inquiry does not create an order or require either party to proceed. The order-related portions become binding when we confirm an order in writing and you accept that confirmation or make a payment toward the order. If a written quote, invoice, or order confirmation conflicts with these Terms, the order-specific document controls for that order.
You must be at least 18 years old and able to enter into a contract to place an order.
Orders and payment
Inquiries and acceptance
Website and social-media submissions are requests only. An order is accepted after we confirm its key details in writing, including the items or services, price, date, and pickup or delivery arrangement, and you accept or pay as requested. We may decline a request based on availability, timing, scope, food-safety concerns, or other reasonable business considerations.
Accurate details
You are responsible for accurate contact, event, handoff, serving, design, dietary, and allergen information. Review the confirmation promptly and tell us about any error.
Prices, deposits, and balances
Prices are in U.S. dollars. Your confirmation will state the price, any delivery or setup fees, required deposit or advance payment, and balance due date. Unless it says otherwise, the full balance is due before pickup, delivery, or service. We may pause or cancel work if a required payment is late.
Changes and cancellations
Customer changes
Request changes in writing as early as possible. Changes are not guaranteed and may affect price, appearance, portions, or completion time. A change becomes part of the order only after we confirm it.
Customer cancellations
Cancel in writing. Any cancellation schedule disclosed before payment controls. If none was provided, we will refund amounts paid minus the reasonable value of work already completed and ingredients, supplies, rentals, or other nonrecoverable costs committed to the order. No refund is due for completed custom goods after handoff except under Quality concerns or as required by law.
BakeDrop cancellations
If we cannot complete an accepted order, we will notify you promptly and refund amounts paid for items or services we do not provide. We may offer a substitution or new date, but you do not have to accept it.
Ingredients, allergens, and food handling
Tell us about every food allergy before the order is accepted. Products may be prepared in a shared kitchen, so we cannot promise an allergen-free environment unless we expressly confirm that in writing for your order.
We will provide ingredient and allergen information required for the product. You are responsible for deciding whether it is suitable for you and your guests and for sharing it with anyone who will eat the product. If someone has a severe allergy or cross-contact sensitivity, do not serve them a product unless you have discussed the risk with us and are comfortable with our written response.
Follow all storage, refrigeration, serving, and consumption instructions. Remove supports, skewers, wires, toppers, flowers, and other non-edible decorations before serving, and supervise children around those items.
Custom designs and handmade variation
Reference images communicate direction; they do not promise an exact copy. Handmade goods reasonably vary in color, texture, size, decoration, placement, and finish. Screens, lighting, ingredients, weather, and food safety may also affect the result. We may make minor substitutions that preserve the order's overall quality, servings, and agreed concept.
You represent that you may ask us to use any names, logos, artwork, photographs, toppers, flowers, or other materials you supply. We may refuse materials that are unsafe, unlawful, discriminatory, or that we reasonably believe infringe another person's rights.
We may photograph the finished product before handoff and use those photographs in our portfolio, website, or social media. Tell us in writing before the scheduled date if you want to opt out. We will not intentionally publish customer contact information, guest faces, or private event details without permission.
Pickup, delivery, and event setup
Pickup
Arrive during the confirmed window with a level, secure space suitable for the product. After the order is inspected and handed to you or your designee, you are responsible for safe transport, storage, display, and service. We are not responsible for later damage caused by movement, heat, weather, improper storage, mishandling, or venue conditions.
Delivery and setup
Delivery times are reasonable estimates unless we agree to a fixed time. Provide the correct address, access and parking instructions, and an authorized recipient. Reasonably incurred waiting, redelivery, parking, toll, venue, or access costs may be charged if disclosed.
For setup, provide timely venue access and a stable, level display area away from direct sun, heat, moisture, pets, and heavy traffic. Responsibility transfers to you or the venue representative after setup is completed and accepted.
Quality concerns and remedies
Inspect the order at handoff when practical. If an item does not materially match the accepted order or has a quality or safety issue, contact us as soon as possible and no later than 24 hours after handoff. Include photographs and keep the affected product so we can evaluate it. This notice period does not limit rights that cannot legally be limited.
For a verified concern, we may correct or replace the item or provide an appropriate partial or full refund. Handmade variation or a subjective preference is not, by itself, a defect when the product materially follows the accepted order.
Website and content use
Website photos, descriptions, examples, availability, and prices are informational and may change. They do not create a quote, guarantee availability, or promise that a future order will duplicate a past bake.
The website and its original text, branding, graphics, photographs, and design belong to BakeDrop or are used with permission. You may use the site for personal, noncommercial browsing and ordering. You may not scrape, copy, republish, interfere with, probe, or misuse the site or submit unlawful, harmful, or deceptive material.
Third-party links and services, including Instagram and our inquiry form provider, have their own terms and privacy practices. We are not responsible for third-party services we do not control.
Disclaimers and limits of liability
We do not promise that the website will always be available, secure, or error-free. To the fullest extent allowed by law, BakeDrop is not liable for indirect, incidental, special, exemplary, or consequential damages or losses caused by circumstances outside our reasonable control.
To the fullest extent allowed by law, BakeDrop's total liability arising from an order will not exceed the amount paid for the affected order. These limits do not apply to personal injury caused by our negligence, fraud, willful misconduct, gross negligence, or any right that applicable law does not allow us to exclude or limit.
General terms
Events outside reasonable control
Neither party is responsible for delay or failure caused by events outside reasonable control, such as severe weather, wildfire, utility interruption, illness, government action, transportation disruption, or venue closure. We will communicate promptly and reasonably try to reschedule, substitute, or refund the unprovided part of the order.
Oregon law
Oregon law governs these Terms. Court proceedings must be brought in a state or federal court with jurisdiction where BakeDrop is located, unless consumer law gives you the right to bring them elsewhere. Before filing a claim, both parties will make a good-faith effort to resolve the issue directly.
Severability and entire agreement
If a provision is unenforceable, it will be limited or removed only as necessary, and the rest will continue. Not enforcing a provision is not a waiver. These Terms and the accepted quote, invoice, or order confirmation are the entire agreement for an order.
Updates
We may update these Terms by posting a revised version and effective date. Changes apply prospectively. The version in effect when an order is accepted continues to govern it unless both parties agree otherwise.
